The HC, while considering Thachankary’s pleas for relaxation, wondered how it could happen that an accused fell ill upon being sent to jail but recovered after being released.

In an interesting development, former Kerala DGP Tomin J Thachankary (IPS:1987:KL), currently out on bail in a disproportionate assets case, has moved a petition in the High Court seeking relaxation of a bail condition to travel abroad. His bail condition bars him from going abroad without the court’s permission.

Thachankary was earlier sent to jail following his conviction and sentencing by the vigilance special court in Kottayam in the disproportionate assets case.

The Kerala High Court, while considering his petition, questioned the justification of his request on Monday, saying he had been admitted to a jail hospital for various ailments while in custody but was now seeking permission to travel abroad after being released on bail.

The court noted that Thachankary had reportedly been admitted to a jail hospital for 28 days during his four-week detention. The court wondered how it could happen that an accused fell ill upon being sent to jail but recovered after being released.

Thachankary has submitted that he could lose his job if he failed to return to work abroad. Thachankary also stated that he had been working as an operations manager with a jewellery group in Sharjah and was a partner in a business concern.

Justice A Badharudeen has now asked the jail superintendent concerned for the details of Thachankary’s hospitalisation during his four-week detention. According to the court’s instructions, the report should specify for how many days he was admitted to the jail hospital and the ailments for which he received treatment. It should also state the number of days he was not in hospital so that the court could assess the genuineness of his request to travel abroad.

The court adjourned the hearing to Friday.
