The Supreme Court lashed out at the Union Government on Wednesday, saying it had violated its earlier direction to conduct a cadre review of the Central Armed Police Forces (CAPFs). The top court has directed the Cadre Review Committee to submit its proposal for approval by November 30.
The apex court also sought details of the proposal prepared by the Review Committee for approval.
During the previous hearing on October 15, the top court had asked the Centre to submit original files and after examining them the bench noted that the Centre had violated its May 2025 direction for cadre review within six months.
A bench of Justices Manoj Mishra and Ujjal Bhuyan went on to ask the Centre to provide data on the deputation of IPS officers to the five CAPFs up to the level of Senior Administrative Grade (SAG).
The bench also asked the Centre to file an affidavit detailing deputations of IPS officers in each CAPF as on May 23, 2025, and the current position.
The top court was hearing petitions challenging the new CAPF Act, along with a contempt plea filed by CAPF officials over the Centre’s alleged failure to comply with its May 2025 orders.
CAPF officials had alleged that the Centre had failed to comply with the top court’s direction to conduct cadre reviews in the CAPFs within six months.
The cadre reviews in all the five CAPFs, due since 2021, were required to be completed within six months under the court’s May 23, 2025, order. In that judgment, the apex court had directed the Centre to undertake the progressive reduction in deputation of IPS officers to the CAPFs.
The contempt petitioners have alleged that the Centre had increased such deputations instead. The fact is Union Home Secretary had admitted before the court that 46 IPS officers had been deputed to the CAPFs after the apex court’s May 2025 orders.
The court had earlier said that the new CAPF Act that came into force on October 8 had no bearing on the cadre review of the five forces.
The top court has listed the matter for hearing on December 9.
