The Kerala High Court on Wednesday (July 15, 2026) reserved its order on whether to accept the unconditional apology submitted by IAS officer K Biju (IAS:2006:KL) or continue contempt proceedings against him in the Kerala State Cashew Development Corporation (KSCDC) corruption case.
Justice A. Badharudeen said the Court would decide whether the apology was sufficient or whether the contempt case should proceed. The issue relates to the prosecution sanction order issued by Biju, Secretary in charge of the Cashew Development Department, which contained remarks against the judiciary.
During the hearing, the Court noted that Biju, an officer with 17 years of service, had issued the original order with remarks that were later withdrawn after the Advocate General found them prima facie contemptuous.
Biju later filed an unconditional apology. He also submitted a fresh affidavit stating that the revised prosecution sanction order had been issued after proper application of mind.
The High Court directed the Kerala government to send the revised prosecution sanction order to the CBI without delay.
The Court also indicated that it may examine whether the revised sanction order meets the legal requirements.
The matter will be taken up again on Friday (July 17, 2026).
