The OBC creamy layer case, currently pending in the Supreme Court, will not be affecting the seniority of successful candidates of 2025 batch of the Civil Services Examination. This is important as, according to sources, their service allocation and foundation course are yet to be finalised.
As per the Department of Personnel and Training (DoPT) officials, the DoPT and all training institutes are now ready to allocate services to Civil Services Examination – 2025’s successful candidates expeditiously and commence foundation course at the earliest. Officials said delay in the foundation course will have no bearing on the seniority, gradation or other service conditions of these candidates.
This clarification is important as the apex court, in its Rohith Nathan judgement of March 11, had ruled out “salary” to be added to “income” for defining “creamy layer” criteria for any category of OBC candidates, including those whose parents are employed in PSUs/banks, etc. The judgement came in the case filed by candidates coming from PSU background, saying they were being categorised as “creamy layer” by including “salary” in the “income” of their parents over the years.
