IPS officer Abhishek Mohanty challenges AP cadre allotment in CAT, seeks retention in Telangana

IPS officer Abhishek Mohanty (IPS:2011), who was recently relieved as Karimnagar Police Commissioner and from the Telangana cadre, has approached the Central Administrative Tribunal (CAT), Hyderabad Bench, challenging the Union Ministry of Home Affairs' order allotting him to the Andhra Pradesh cadre instead of his preferred Telangana cadre.

IPS officer Abhishek Mohanty (IPS:2011), who was recently relieved as Karimnagar Police Commissioner and from the Telangana cadre, has approached the Central Administrative Tribunal (CAT), Hyderabad Bench, challenging the Union Ministry of Home Affairs’ order allotting him to the Andhra Pradesh cadre instead of his preferred Telangana cadre.

Mohanty has requested the tribunal to suspend the February 19 order and direct the Centre, along with the Andhra Pradesh and Telangana governments, to allow him to continue in the Telangana cadre.

In his petition, he argues that the authorities failed to properly consider his domicile records, which, according to him, qualify him for the Telangana cadre. Mohanty asserts that he is a permanent resident of Hyderabad, which falls within Telangana, and that this fact was overlooked. He claims his case falls under paragraph 5.1.3 (I) of the Pratyush Sinha Committee’s recommendations.

He also referenced a July 19, 2021, CAT order, which stated that he had been incorrectly classified as an outsider despite being a direct recruit from the Telangana region. Drawing a parallel with IAS officer Lotheti Siva Sankar (IAS:2013), whose cadre allotment to Telangana was recently restored by CAT on domicile grounds, Mohanty argued that he should receive similar consideration.

Both CAT and the High Court have previously upheld his Telangana domicile status, yet the central government did not review this aspect while rejecting his representation.

Mohanty has urged the tribunal to direct the Centre to reconsider his case from a domicile perspective and to suspend the allotment order, allowing him to continue in Telangana until a final decision is made.
