The Andhra Pradesh High Court has stayed the Central Administration Tribunal (CAT)’s orders revoking the suspension of senior IPS officer Vishal Gunni (IPS:2010:AP), saying a detailed hearing is necessary in the matter. The stay on the revocation of Gunni’s suspension will be in force till further orders, the High Court said.
The High Court bench comprising Justices Manavendranath Roy and Tuhin Kumar issued the stay order.
The CAT had directed the state govt to take Vishal back in service and pay him salary, including all allowances, for the suspension period. The state govt then moved the High Court, challenging CAT’s order. The IPS officer was suspended after being charged with illegal arrest and misuse of power following an alleged harassment of a Mumbai-based actress.
It was argued on behalf of the state govt that Gunni went to another state to arrest the actress even before the FIR was registered in the case. Describing it as serious misconduct, the govt argued that police could not proceed further in the investigation as the suspension orders were revoked by the CAT.
Gunni’s counsel said the petitioner acted upon the directions of his superiors and did not participate in the arrest of the actress.
After hearing the arguments, the HC bench stayed the CAT’s order for revocation of his suspension.
The matter was posted for further hearing on Aug 29.
