The Haryana government will be giving seven days’ advance notice to ex-IAS officer D Suresh (IAS:1995:HY) if his custody is required for investigation. The state govt has given an undertaking in this regard to the Punjab and Haryana High Court.
A senior IAS officer of the Haryana cadre, D Suresh retired on August 31, while the High Court had taken up the matter on August 27.
An FIR had been lodged by the Haryana Police on August 26 against nine accused, including IAS officer D Suresh who moved the High Court against it. His petition came up for hearing before Justice Tribhuvan Dahiya’s Bench on August 31.
In the petition, IAS officer D Suresh has submitted that as he was going to superannuate from service on August 31, the FIR was meant to prevent him from getting the due retirement benefits.
The state govt, on the other hand, submitted that sanction to register the FIR was received from the government on July 29. It was forwarded to the Vigilance Bureau, Gurugram, on August 3. The draft FIR was sent to the head office on August 13 and approved on August 25. “Finally, it was registered on August 26. Due procedure has been followed and there is no mala fide involved,” the govt told the Bench.
The govt’s counsel later stated that in case the petitioner’s custody is required during investigation, he will be issued seven days’ advance notice.
The HC Bench later listed the matter for hearing on October 16 after the state counsel accepted the notice on behalf of the respondents and sought time to file a reply.
