The Supreme Court has dropped contempt proceedings against Maharashtra Additional Chief Secretary Rajesh Kumar (IAS:1988:MH). The contempt proceedings against Kumar had been initiated after he, in his affidavit, accused the top court of not following the provisions of law in a Pune land case.

Kumar attracted court’s ire for submitting in his affidavit that it is the bounden duty of the state to follow the provisions of law. The court drew inference that it meant like saying that the court was not following the provisions of law and found it defamatory.

The court, however, said on Monday that as several lawyers had vetted it, Kumar could not be held “singly guilty” for it and decided to drop the proceedings.
