The central government on Wednesday (26.07.2023) moved the Supreme Court seeking an extension of Enforcement Directorate chief Sanjay Kumar Mishra’s tenure as his term is set to end on July 31, in accordance with a recent SC judgment, which ruled that the extensions given to his term were illegal.

A bench headed by Justice BR Gavai agreed to hear the government’s application on Thursday (July 27) after Solicitor General Tushar Mehta, appearing for the central government, mentioned the matter for urgent listing. The bench posted the matter for hearing on Thursday at 3.30 pm.

On July 11, a bench of Justices BR Gavai, Vikram Nath, and Sanjay Karol struck down the earlier extension granted to Mishra on the ground that it violated the Supreme Court’s 2021 judgment. The top court directed Mishra to quit on July 31 – four months before his third extension ends in November. The court ruled that the two extensions given to him in November 2021 and November 2022 were illegal.
