The Punjab and Haryana High Court has issued notice to the Haryana government on a plea that the state police is operating with far excess number of ex-cadre posts for IPS officers in violation of the Indian Police Service (Fixation of Cadre Strength) Amendment Regulation, 2017 against the sanctioned strength of 19 IPS ex-cadre posts in the Haryana Police.
According to the petitioner, several officers are occupying ex-cadre posts despite equal numbers of cadre posts being vacant. The state has kept several cadre posts vacant for reasons well known to them. However, It is mandatory to fill up the cadre positions first under rule 10 of the Indian Police Service (Cadre) Rules, 1954.

The notice has also been issued to 31 other IPS officers of the state who have been allegedly posted on non-sanctioned posts in violation of the prescribed norms.
According to the petitioner, 31 IPS officers in the state police occupy public offices unauthorisedly and in violation of the rules. The petitioner also informed that it is mandatory to take the concurrence of the state finance department while creating any ex-cadre posts in the Haryana Police. The petitioner says no such concurrence has been obtained by the state’s home department while creating most of the excess number of ex-cadre posts with which Haryana Police operates as of date. Therefore, such posts are illegal and in violation of India Police Service (Fixation of Cadre Strength) Amendment Regulation, 2017.

Justice Vinod S Bhardwaj of the HC has issued the notice after taking cognisance of a petition and the matter has now been adjourned for September 14 for further hearing.
Furthermore, the Public Accounts Committee (PAC) of the Haryana Assembly has taken cognisance of the excess number of ex-cadre posts being created for IPS officers within the Haryana Police, which is in violation of the rules.
