Centre proposes to keep corrupt babus suspended, if convicted by court

The corrupt IAS, IPS and IFS officers will remain suspended, if they are convicted by court in a corruption or criminal case. The centre has proposed changes in service rules to this effect.

The DoPT has decided to amend the All India Services (discipline and appeal) Rules, 1969, applicable to Indian Administrative Service (IAS), Indian Police Service (IPS) and Indian Forest Service (IFS) officers.

According to the sources, a clause will be added in the existing rules to say “no review shall be conducted till the passing of the final order in the court case, if any, if a member of service is deemed to have been placed under suspension under Rule 3 of AIS (D&A) Rules, 1969 on conviction by a court of law in criminal and corruption charges”.

The DoPT has sought the comments of the cadre controlling central ministries of these services, besides the Chief Secretaries of all states, on the proposed amendments.

They have been requested to respond positively by May 15.

“If no reply is received within the stipulated time, it will be presumed that the state government has no objection to the proposed amendment,” the communiqué said.

As per existing rules, the first order of suspension remains valid for 60 days, which can be extended, for a further period not exceeding 120 days, unless revoked earlier.
