Haryana : Resentment among IAS cadre over other services being allocated cadre posts

The phenomenon of IAS Cadre posts being given to officers from other services have become rather a norm and so is resentment among cadre officers over it.

Earlier it was the state of Andhra Pradesh and now it is the turn of the power corridors of Haryana, where IAS Officers complain of usurping of IAS Cadre posts by officers from other services, being seen as an attempt of the state government to shrink their domain space. Senior Haryana Cadre officers complain of the state government appointing their favoured officers in IAS Cadre postings, irrespective of the services they represent.

If a recent transfer order issued by the state government is an indicator, the Haryana IAS cadre’s concerns are somehow genuine. In a recent major bureaucratic reshuffle in the state, an IPS officer is given Principal Secretary’s post, while another is given the charge of Managing Director of one of the power utilities and another IFS officer is given the post of Principal Secretary. All these postings are normally the domains of senior IAS Officers, causing heartburn among the IAS officers of Haryana cadre and promoted officers of the state civil services. Adding further insult to the injury the state government posting DSPs and Employment Officers against the post of District Transport Officers (DTOs).

Senior Haryana Cadre IAS officers on condition of anonymity vehmently criticise such attempts of the state government and term it illegal and reckless, where laid-down procedures are being ignored and an experimental approach is being followed. Many IAS Officers also feel that, if senior police officers are not needed for policing, as evident from the Administrative posts being allocated to them, the Home Secretary should review the cadre strength and reduce it rather than wasting the taxpayers’ money. They also ask, though in hushed tones, in a state marred by constant law and order issues in recent times, IPS Cadre should be left to focus on policing, rather than positions such as the Chairman of the Police Housing Corporation, that require administrative experience. Similarly, a number of vacant posts in the Indian Forest Service, where no domain expertise is required, the government should consider posting IAS officers for their proven and better administrative strengths.

In other words, the IAS Cadre feel threatened due to this continuous influx of officeres from other services in domains which generally are manned by them. They also express apprehensions that today it’s IPS officers, tomorrow even cadre from CRPF and BSF can be brought in their place, shrinking and undermining the career prospects of the IAS Officers of Haryana cadre.

However, when contacted, our sources in the government, however, defended the state government’s decision on account of IAS officers being “overloaded” with departments, which comes in the way of smooth working, hence the government attempting to utilise the available resources to their maximum.

CWC First PSU to be awarded Anti-Corruption ISO 37001

The Central Warehousing Corporation (CWC) has become the first CPSU in India to be awarded with certification ISO:37001 on Wednesday (October 28, 2020). It was conferred upon Chief Vigilance Officer of CWC Pranai Prabhakar (IRTS:1991) by Director General of Bureau of Indian Standards (BIS), Pramod Kumar Tiwari.

ISO:37001 is meant for establishing, implementing and maintaining an Anti-Bribery Management System in the Organisation. “It is exhibitive of our sustained resolve and commitment to contain corruption as per the directives and thrust of the government” said CVO, Pranai Prabhakar. The certification coincided with the celebration of Vigilance Awareness Week, 27th Oct – 2nd Nov, 2020.

Central Warehousing Corporation is one of the public warehouse operator established by the Government of India in 1957 to provide logistics support to the agricultural sector. It operates 421 warehouses across India with a storage capacity of 10 million tonnes. The services include foodgrain warehouses, industrial warehousing, custom bonded warehouses, container freight stations, inland clearance depots and aircargo complexes.

J&K : Union Power Secretary Sanjiv Nandan Sahai and NHPC CMD A.K. Singh visit Salal Power Station

Power Secretary of Government of India Sanjiv Nandan Sahai visited NHPC’s 690 MW Salal Power Station, Jammu & Kashmir on 28.10.2020. He was accompanied by A.K. Singh, CMD, NHPC, Tanmay Kumar, Joint Secretary (Hydro), Ministry of Power, Government of India, Rohit Kansal, Principal Secretary, PDD, UT of J&K and Rajan Kumar, Chief General Manager, Regional Office Jammu, NHPC during his visit to the Power Station.

The visiting dignitaries were welcomed by Nanhe Ram, General Manager (In-Charge), Salal Power Station, and other Senior Officers from NHPC, CISF, and Civil Administration at Ramleela Ground, Jyotipuram. This was followed by Guard of Honour by CISF. Power Secretary and CMD, NHPC along with Joint Secretary (Hydro), Principal Secretary, PDD, J&K, and other Senior Officials of Salal Power Station visited various components of the Power Station including the Power House. Sahai inaugurated “Renovated
Units of Salal Power House”. The visiting dignitaries were apprised of the Operation and Maintenance activities of the Power Station by General Manager (In-Charge), Salal Power Station through PowerPoint Presentation.

Speaking on the occasion, Secretary (Power) appreciated the initiatives taken by Salal Power Station under the dynamic leadership of CMD, NHPC for improving the performance of the Power Station and expressed happiness to visit one of NHPC’s prestigious Power Stations. He emphasized for time-bound delivery of the hydro projects and said that GOI has already taken initiatives for promoting hydro projects through a new hydro policy in March

He further called for undertaking the development of pump Storage Schemes by NHPC for ensuring grid stability taking into consideration the high penetration of Renewable Energy in the Indian Grid.

A.K. Singh, CMD, NHPC expressed his gratitude to Secretary (Power) for taking time off his busy schedule and visiting the Salal Power Station which reflected the due importance being given to hydropower projects by the Government of India.

Selection to civil services can’t be whimsical process, norms to be followed : Delhi HC

(PTI) : Selection to civil services cannot be a whimsical process and it has to follow certain norms and procedures, the Delhi High Court has said while observing that failure of the state in following the discipline can lead to misgovernance and misuse by vested interests.

The high court made the observation while holding as ‘maintainable’ the plea by 20 non-state civil service officers of Rajasthan, who are aspirants for appointment to the Indian Administrative Service of the Rajasthan cadre, challenging cancellation of interviews by the selection committee.

Justice Prathiba M Singh said the cancellation of interviews as in the present case is not to be viewed solitarily as a one-off incident and it represents a deeper malaise in selection, which ought to be conducted fairly and in a transparent manner.

“Selection to the civil services, especially the IAS – a coveted service, cannot be a whimsical process. It has to follow certain norms, procedures and discipline. When the state or any instrumentality thereof fails to follow the said discipline, it can lead to misgovernance and misuse by vested interests,” the high court said.

It said when the court finds that the selection mechanism is being impeded, successively, it cannot turn a blind eye.

“Such a case would require interference by the exercise of writ jurisdiction in order to examine as to whether the prescribed norms for selection were adhered to, and if not, then, to consider the remedial measures. The circumstances in the present case accordingly warrant interference under Article 226 of the Constitution,” the high court while holding the petition maintainable.

In the petition, the 20 non-state civil service officers (non-SCS) of Rajasthan, who are aspirants for appointment to the IAS for the year 2018, in the non-SCS category, have challenged the December 31, 2019 letter issued by the Union Public Service Commission (UPSC) by which their interviews scheduled to be held on December 31, 2019 and January 1, 2020, by the selection committee, were cancelled.

The petitioners’ stand is that two members of the selection committee who were to be nominated by the central government, according to Regulation 3 of the IAS (Appointment by Promotion) Regulations, 1955, were not nominated because of which the interviews that were fixed for December 31, 2019 and January 1, 2020, had to be cancelled.

Thereafter, no steps have been taken to hold these interviews and the four vacancies, which were declared by the state of Rajasthan, have been subsumed in the vacancies for the next year, the plea said.

The petitioners prayed that the central government should be directed to nominate its two members to hold the interviews and the selection process should be allowed to proceed further at the earliest.

Preliminary objections were raised by the government and the UPSC that the Delhi High Court does not have the territorial jurisdiction to hear this petition and that the Central Administrative Tribunal (CAT), Jaipur is the appropriate forum to deal with the dispute.

On the issue of territorial jurisdiction, the high court said that during the pandemic, almost all the courts and tribunals are functioning at a very bare minimum and relegating the petitioners to approach CAT would lead to further delays in their candidature being considered for selection to the IAS.

“Though the CAT may be functioning during the pandemic, there is no doubt that the same is through video conferencing, at a bare minimum level. Under such circumstances, to reject the prayer of the petitioners would cause substantial injustice as the petitioners may be left completely into an uncertain arena, in sofar as the selection is concerned.

“The cancellation of the meeting of the selection committee deserves to be examined in writ jurisdiction,” it said.

Direct Port Entry facility inaugurated at VO Chidambaranar Port

An initiative which will have far reaching implications in reducing logistics cost and boosting ease of doing business, Union Minister Mansukh Mandaviya inaugurated direct port entry facility at VO Chidambaranar Port.

Speaking on the occasion through video conferencing, the Union Minister of state for Shipping said that the facility will help increase ease of doing business for exporters and will bring efficiency by improving competitiveness of shippers in international trade and reduce dwell time and tariff cost.

The new facilities will also enable direct movement of containers from factories, without intermediate handling at any CFS, thus facilitating shippers to gate-in their factory stuffed exports directly to the container terminal on 24×7 basis and can handle 18,000 twenty-foot equivalent units (TEUs) per month.

Shipping Secretary Sanjeev Ranjan, senior officials of the ministry; TK Ramachandran, Chairman, VO Chidambaranar Port Trust; Arun Kumar Shrivastava, Managing Director, CWC and other port officials were present in the virtual inauguration.

The Haryana government on Wednesday has partially modified the transfer posting orders of 33 IAS officers issued on 26.10.2020. Some of the officers on this have been assigned duties with minor changes. In this modified list, some new officers have been added.

Four General Managers appointed in Railways

The Modi government on Tuesday approved the appointment of four General Managers in the Railways.

They are ;

  2. Ashutosh Gangal (IRSME:1985) : General Manager, Northern Railway, New Delhi.

Railway Board’s directive for due diligence in probe against suspected employees

In a significant development, a Railway Board advisory has directed its vigilance officials to follow due diligence and providing an opportunity of explanation to suspected employees, while investigating cases. This advisory comes after a reported mistake in one of the Zonal Railways where an official who had no locus standi in a case was “erroneously” included in the investigation report along with others sent to the Central Vigilance Commission. The CVC recommended major punishment against the official, who was about to get suspension orders, before the railway authorities realised that he had no role to play in the composite vigilance case. When the matter was reverted, the CVC expressed displeasure for adopting a “lax” attitude during processing of the case, sources in the railways said on Monday.

To avoid recurrence of such instances, the Railway Board in its advisory, has instructed that the version of suspect official should be taken during investigation for arriving at an objective conclusion. The Railway Board sent this advisory note to all Senior Deputy General Managers/Chief Vigilance Officers of Zonal Railways, Production Units, Public Sector Undertakings etc.

In a separate advisory, the Railway Board said the CVC had advised all Chief Vigilance Officers to ensure expeditious finalisation of disciplinary proceedings/action, particularly in respect of officials likely to retire from service shortly.
