Amid the raging row over the continuance of Justice Sanjeev Prakash Sharma as the Rajasthan High Court’s Acting Chief Justice, the Supreme Court Collegium on Monday recommended the appointment of Justice Sanjay K Agrawal as Chief Justice of the Rajasthan High Court.
The move gains significance as Justice Sharma has been at the centre of controversy owing to the allegations of malpractices in the exercise of administrative power leveled by apex court judge Justice Sandeep Mehta. So much so that Justice Mehta wrote three letters to the Chief Justice of India (CJI), Surya Kant, last month, seeking to replace Justice Sharma as the Acting Chief Justice of the Rajasthan High Court by appointing a regular Chief Justice in his place.
The issue further got momentum after lawyers at the Jaipur and Jodhpur benches of the Rajasthan High Court rose in protest, demanding that Justice Sharma be divested of his charge as Acting Chief Justice.
That seems to be a possible reason why the SC Collegium, headed by the CJI, also recommended that Justice Agrawal be transferred to the Rajasthan High Court immediately.
Justice Agrawal is currently serving as a Chhattisgarh High Court judge and had earlier served as Advocate General of the state. He was appointed an Additional Judge in September 2013 and was later confirmed as a permanent judge in March 2016.
